I. INTRODUCTION
All prospective Roaring Fork Valley Vehicles (RFVV) members must read and understand this entire manual before signing their membership agreement. A signed membership agreement indicates an understanding of the various rules and obligations contained in this manual and indicates that the member agrees to abide by all rules and obligations. A signed membership agreement is required before a new member drives an RFVV vehicle. The member's and RFVV's legal rights and obligations are determined solely by the terms in this manual and the membership agreement.
II. DEFINITIONS
In this Manual, RFVV means the non-profit corporation Roaring Fork Valley Vehicles.
Member means a general Member of RFVV; Vehicle means a vehicle owned/leased by RFVV and includes any equipment in the vehicle; Fee schedule means the most current RFVV fee schedule, including any amendments to it.
III. POLICIES AND PROCEDURES
1. Requirements for Membership and Fees.
Each prospective member, along with a non-refundable, $25 application fee, must submit a membership application. RFVV will do a brief credit history check and a driving history check.
Once the application and driver history has been approved, the applicant officially becomes a member of RFVV after they have completed a comprehensive orientation, read and signed a member agreement, submitted a credit card (not a debit card) and been issued a key. A debit card will be accepted with a refundable $500 cash deposit due at the orientation.
In the event of an accident, members may also pay up to $500 to cover the insurance deductible in the case where the member is deemed to be "at fault" or if the member is NOT deemed "not at fault". To clarify, if there is any doubt that the other party involved in the accident may not be at fault, the member will be charged the $500 deductible and refunded ONLY at the time that the matter has been resolved with the other party.
Please note that RFVV reserves the right to refuse membership to anyone based on driving record, credit history, vehicle constraints, etc.
2. Covering Costs.
RFVV is a Colorado nonprofit corporation dedicated to offering its members access to its fleet of vehicles at a reasonable cost. The fee structure is designed to spread all of these costs between its members in as fair a way as possible.
3. Monthly Fee. (See fee schedule for specifics) Currently $10.00/month, price subject to change. $5.00 for each additional membership on an existing account.
Each member pays a monthly administration fee, even if they do not use a RFVV vehicle during a particular month. Membership may be suspended by the customer at anytime by returning the issued key to the office in person unless otherwise specified by the acting manager.
4. Usage Fee. (See fee schedule for specifics) Currently $4.00/hr, $.30/mile, price subject to change.
When a RFVV vehicle is booked, the member pays a mileage fee and an hourly fee for each quarter hour for which the vehicle is booked. The hourly fees are waved between the hours of 11pm and 7am to allow members to return a vehicle the next morning without additional cost. Late fees will be assessed if a member returns a vehicle late.
RFVV will run promotional rates for certain trips i.e. Fixed Daily Rate (FDR) will allow a member to reserve a vehicle for 24 hours and drive 300 miles for $65.00. ($2.00 Refuel credits do not apply) Additional time and mileage can be added at RFVV regular rates.
5. Payments.
Members agree to be bound by the current Fee schedule and pay for usage as billed. All RFVV members will be billed monthly. Bills will be sent out the week of the 15th of each month. Payment is due by the end of that month. For example usage for the cars in January will be reflected on the bill sent out the 15th of February, payment would be due by the end of February.
RFVV staff will calculate each memberÕs monthly bill based on both the records from the electronic phone scheduling system and from the Trip Log Books kept in each vehicle.
Monthly bills will be sent via US Mail to the address members specify. Payment can be made by personal check or money order, received directly by RFVV. Full payment must be received by RFVV by the due date. If payment has not been received at the RFVV office by the end of the month, the credit on file will be charged the entire account balance. Members who are not able to keep a credit card on file who have not submitted payment by the end of the month will incur a minimum late charge of $5.00
6. The Scheduling System.
RFVV's telephone scheduling system is completely automated. There is no need to talk with the RFVV office for scheduling. The telephone scheduling system includes these features:
Reserving any RFVV vehicle
Canceling a reservation
Changing a reservation
Searching for Other Member Phone Numbers

7. Reserving a Vehicle. 1-(866) THE RFVV / (866) 843-7388
A Member must reserve a RFVV vehicle before using it, even for immediate use.
Vehicles are reservations are rounded to the nearest quarter hour. Be sure to allow enough time.
When making a reservation, always assume another member is waiting to use the vehicle and is expecting a timely return. If in doubt, it is best to add extra time to the reservation.
When entering your reservation please use a start time of 15 minutes earlier than the planned time of your departure. This will ensure that if anyone schedules the vehicle before you they will be required by the scheduling system to end their reservation before yours starts. There will then be a 15-minute buffer in place. RFVV strongly suggests you add 30-minute to the end of your reservation as well. This will help you avoid any late charge. (Currently $20.00 per hour plus any other incurred expenses)
Members are responsible for returning the vehicle on Ðtime and in useable condition. Members are responsible for making sure the gas tank is at least one-quarter full, free of personal items, and trash. The vehicle must also be clean enough for the next member. If the vehicle is excessively dirty, a clean-up fee of up to $50.00 may be charged. CDs may be left in the visor mounted C.D. holder. RFVV is not responsible for personal items left in carshare vehicles.
8. Booked Vehicle Unavailable.
If the vehicle is not at its regular parking spot fifteen minutes after the beginning of the reserved time, the member may:
a) choose to cancel his/her reservation without charge, or
b) reserve another RFVV Vehicle.
c) if no other RFVV Vehicle is conveniently available, the driver may use a taxi. Members can submit their taxi receipts to RFVV for reimbursement.
9. Late Return of Vehicle.
RFVV depends on its members to return vehicles on time, so as not to inconvenience other members. If late return of the vehicle is unavoidable, members should call the reservation system at 1-866-THE RFVV to see if the reservation may be extended (if no other member has booked the vehicle immediately after your reservation). Extending the reservation will allow you to avoid late fees. If this option is not possible due to another reservation, members should immediately contact RFVV staff at 920-5066. A late charge of $20 per hour plus any taxi fares will be charged. For example, if a member is 15 minutes, a charge of $20.00 will appear on you next bill. If your late return also inconveniences another member, you will pay the $20.00 late charge plus any incurred taxi fares up to $50.00.
10. Cancellations
A member may cancel all or part of a reservation with no fee if the cancellation is made at least 24 hours prior to the start time of the reservation.
If you find that you will not need a vehicle for the full extent of your reservation, cancel your reservation during the time that you do not need the vehicle. If the vehicle is reserved by another member you will not be charged for that time. If no one else uses the vehicle, you will be charged the regular hourly amount.
11. Permitted Drivers.
Only RFVV members may drive or operate a RFVV vehicle. Members are customers who have completed and signed an RFVV application form and have submitted it to the RFVV office to be faxed for a Motor Vehicles Report. Drivers must have a current, valid, driverÕs license. International customers have to acquire their own MVR from their license-issuing country.
12. Carrying of a Valid Driver's License.
The rights of membership are conditional on the possession of a valid driver's license. Drivers must carry with them a valid driver's license during every trip. If the driver's license is suspended, withdrawn or expires, for whatever reason, the member's right to drive expires immediately. Members are required to inform RFVV immediately of any suspension, expiration or withdrawal of a driver's license.
13. RFVV Keys.
Each RFVV member is provided a lock box key that provides access to the ignition key of each RFVV Vehicle. The keys remain the property of RFVV. Members are liable for the loss, deterioration and any possible misuse of the keys and other material. If a member loses a key, RFVV must be contacted and informed of the loss. Key replacement fees will be charged in the amount of $30.00. To protect RFVV vehicles from misuse, members should not mark their lock box keys with anything that indicates they are for an RFVV Vehicle. Members are forbidden from making copies of the keys.
14. Pre-Drive Vehicle Inspection
Before using the RFVV vehicle the driver must check for any visible defects. If a member finds a defect, RFVV must be informed by phone (or voicemail) before departure. If RFVV has not been informed before departure, the last user will be liable for the damage.
RFVV members should find the following items in the vehicle glove box or console:
Vehicle insurance and registration;
OperatorÕs manual;
Registration and proof of insurance;
Trip Tickets;
Wright Express Fuel Card;
Road Side Emergency Card;
Membership Manual;
Defect List;
Accident Pack.
Members should inform RFVV if any of these items are missing and must not drive the vehicle if current insurance and registration are missing.
15. Safe Driving.
All members share the responsibility of keeping RFVV's insurance rates as low as possible. Driving safely includes, but is not limited to:
Obeying speed limits and all traffic signs and signals.
Following other vehicles at a safe distance.
Not driving when tired or otherwise impaired.
Ensuring that all passengers are correctly wearing seatbelts.
Operating the vehicle according to the operator's manual.
16. Restrictions.
Children under the age of 12 are required to be seat belted in the rear seats, and where
appropriate use child seats appropriate to their age and size.
*Smoking is prohibited in all RFVV Vehicles.
*Pets are prohibited except inside a secured pet-box.
*No pets are allowed (even in a carrier) in 001
RFVV vehicles may not be driven outside of program boundaries. Program boundaries are West Grand Junction city limits on I-70. East Vail Exit on I-70. The vehicles may drive off of Colorado Highway 82 and Interstate 70 no more than 10 miles either east or west or north or south. Some exceptions include: Maroon Bells Parking lot. Reudi reservoir Parking lot turn-off. Top of Mc Clure Pass on 131. Other than these exceptions these geographic restrictions must be obeyed. Offenders may be subject to additional charges and/or expulsion from the program.
New Members: Glenwood Springs city limits
3 Months in good standing with RFVV: Grand Junction / Vail city limits
6 Months in good standing with RFVV: Denver city limits / Front Range (Prior Verbal approval required for all members)
Trips outside RFVV boundaries may be approved on per-use basis. Drivers must have verbal approval from the program manager to use the vehicles for trip outside existing boundaries. Failure to comply with these rules will result in membership termination plus fines.
Vehicles may not be:
driven in any race or competition,
used for any illegal purpose,
used while the driver is under the influence of any intoxicating substance,
used on roads that are not regularly maintained, or
used to transport firearms.
17. Refueling.
Each member is responsible for returning the vehicle with the fuel tank over 1/4 full.
If the vehicle needs gas, the member should fill the tank using the RFVV credit card inside the center console. Should a member use their own credit card, they may provide RFVV their receipt and receive a credit on their next invoice. A $2.00 refueling credit will apply if Fleet Fueling Protocol is followed:
Please use your 4 digit PIN code as the Driver Number or PIN when using the Wright Express Fleet Fueling card. Your PIN is the number you use to log-into the reservation system.
To receive the $2.00 refueling credit you MUST:
- Fuel outside of Aspen / ABC
- Use 85 octane gasoline
- Use the Wright Express Card provided in each vehicle
- Write member number (or name) and vehicle number on receipt
- Leave receipt in center console
- Check appropriate boxes and fill out trip ticket completely
- Credit not available on FDR trips
If the fueling card does not work, you may use your own money and be reimbursed
for the cost of the gas. To be reimbursed, please leave a copy of your receipt
in the car with your member number (or name) and the vehicle number on the
receipt.
18. Returning the Vehicle.
The RFVV Vehicle must be properly returned by the end of the booking period. Proper return of the vehicle means that:
it is parked and properly locked, with all its papers intact, at its official parking spot;
the interior of the vehicle is clean;
the trip has been properly and completely recorded in the Trip Log Book;
and the fuel tank is over 1/4 full.
$2.00 penalties may apply if any of the following rules are not respected
19. Parking.
The member is responsible for parking only in designated RFVV parking spaces. Immediately report any use of an RFVV parking spot by non-RFVV vehicles. If no RFVV reserved spot is available at the time of return, park as close as possible in a legal parking spot.
20. Roof Racks.
(Ski and Bike racks available for all Station Wagons)
Members will receive roof rack instruction during their orientation. Members must ensure that any bicycles or other gear is properly secured to the racks. Neither the bike racks nor gear may cause damage to the RFVV Vehicle. Members will be financially responsible for any damage caused by incorrect and / or inappropriate use of roof racks and bicycle racks. RFVV is not responsible for any goods damaged on rooftop carrier.
21. Vehicle Cleaning.
RFVV will undertake the washing of the vehicle according to a set schedule. It is the responsibility of the member to clean the vehicle of any mess that he/she may have made, inside or out. Leaving the vehicle unreasonably dirty for fellow members may result in the member having to pay the cleaning costs. $50.00 clean-up charges may apply.
22. Bad Weather.
RFVV discourages members from driving when extreme conditions have made driving dangerous. Under such driving conditions, members may cancel their reservations, or return an RFVV vehicle late, without charge, providing they leave a message to that
regard. The vehicle should be returned to the designated parking spot as soon as it is safe to do so.
23. Emergency Drivers.
If an emergency occurs and the life or safety of a RFVV Member or another person is at risk, the driver may allow a non-Member to drive a RFVV Vehicle, on the conditions:
that he or she has a valid driver's license;
that the he or she is capable of driving, and is not under the influence of any
intoxicating substance; and
that he or she is only allowed to drive the vehicle under the personal supervision of the
member.
The member who reserved the vehicle is liable for any fees, costs or damages arising from the authorized person's use of the RFVV Vehicle.
24. Traffic / Parking Violations.
If a member gets a traffic or parking ticket while using a RFVV vehicle, that member is responsible for payment. If RFVV receives notice that a parking ticket has not been paid, then the member responsible will be billed and charged an extra fee according to the Fee schedule.
25. Maintenance & Emergency Repairs.
RFVV will undertake regular maintenance of all vehicles. However, during the booked period, drivers must ensure that brake fluid, engine oil, coolant, windshield washer and power steering fluid levels meet operator's manual specifications. Tire pressure
must also be maintained at operator's manual specifications. Any receipts for purchases or repairs made to ensure the vehicle is operable must be marked with the driver's membership number and submitted to RFVV within a week of the incident. The
member will be reimbursed up to a $50.00 limit or, in the case of repairs, a higher if amount pre-approved by RFVV.
26. Accidents and Damage.
Any accident or damage in connection with a RFVV vehicle must be immediately reported to the police and to RFVV by phone or in person. The driver is obliged to secure evidence from any available witnesses, and to provide RFVV with a written description
of the accident and the damage incurred. An accident pack is located in the glove box of each RFVV vehicle. The accident pack provides step by step information about accident procedures. If the procedures in the accident pack are not followed, members may not be covered by RFVV insurance and may be liable for vehicle damage.
If a repair, incurred in an accident, either costs $500 or less, or has been approved in writing by RFVV, a member may arrange to have it completed at their own expense. They will not be compensated for this amount.
27. Insurance, Liability, Deductibles.
RFVV Vehicles carry full liability insurance. Additionally, all RFVV Vehicles carry comprehensive and collision coverage. The insurance conditions are available for members' inspection and can be read at the RFVV office. If a member is involved in an accident and a claim is made against the member or against RFVV, settlement of that
claim will be at the discretion of RFVV or its insurer.
In the event of an accident, a member's liability will normally include the $500 insurance deductible. Members may also be liable for the entire cost of vehicle repair or replacement and claims made by third parties if the member violated the insurance
agreement or failed to follow proper procedure as listed in the accident packet.
During the time a Member has booked a vehicle, it will be assumed that this member was using the vehicle and will be held responsible for any damage to the booked vehicle or claims that are made against RFVV or damages resulting from use of the vehicle.
Any payment owed by a member to RFVV due to an accident or other damage, must be paid within 30 days of the accident/repair.
If a vehicle is damaged during a reservation, and a member is considered by RFVV staff, to be at-fault, any lost income or additional expenses may become the customerÕs financial responsibility. I.e. Improper usage, running out of gasoline, inappropriate vehicle operation.
28. Liens and Impoundment.
If the vehicle is towed and impounded for illegal parking while reserved, the reserving member is responsible for recovering the vehicle and agrees to pay any costs arising from the vehicle being towed. If, without the approval of RFVV, a member allows a lien to be placed on a RFVV vehicle or allows the vehicle to be impounded (for instance, by failing to pay for repairs which the member has authorized), that member is responsible for all costs, court and legal fees incurred by RFVV in pursuing the speedy return of the vehicle as well as any service charge in the Fee schedule.
29. Fees for violations.
If any term or condition of the membership application, this manual, or the rules is violated, the member is subject to any fees applicable under the fee schedule.
30. Suspension if Payments in Arrears.
RFVV may suspend the right of a member to drive if they default in paying any amount owed to RFVV. This can be done, without notice, anytime after payment due date. The suspension remains in effect until such time as any amount owed, including any interest and penalties accrued, has been paid.
31. Automatic Suspension.
The right to drive a RFVV vehicle is automatically suspended if a member is charged with driving without due care and attention or any vehicle related offense. This includes, but is not limited to:
operating a motor vehicle while impaired;
failing to provide a breath sample;
dangerous operation of a motor vehicle;
failure to stop at the scene of an accident.
Failure to follow any of the rules outlined in this manual
32. Automatic Termination.
If a member is convicted of any of the offenses referred to in paragraph 32, their right to drive will be permanently suspended and their membership terminated.
33. Termination by Member.
A member can terminate membership in writing at any time. Membership termination will only be effective upon the return of all RFVV keys in the member's possession.
34. Return of RFVV Keys on Termination.
If either the right to drive is suspended or membership is terminated, the member must immediately return the key that they were issued directly to the RFVV office. Membership can be terminated at any time, provided all payments are up to date.
35. Amendments to the Fee schedule.
RFVV may amend the fee schedule at any time. Within one week of any amendments being made, they will be mailed to all members. Amendments will not be effective any sooner than 14 days after they are made.
36. Special Agreements.
Any agreement, which differs from the terms of this manual, must be made in writing, and signed by an authorized representative of RFVV.
37. Severability.
If any single part of this manual is found to be legally ineffective it shall not affect the validity of the rest.
38. Notice.
If this manual requires RFVV or the Board to give notice, notice will be sent to the member at the address provided in their membership application. In the event of a change of address, the member must notify RFVV in writing.
IV. MEMBERSHIP AGREEMENT
I recognize that:
If RFVV (RFVV) accepts my application, the terms of the application along with the terms of the RFVV manual immediately constitute a binding contract;
RFVV's acceptance of my membership application is subject to a successful check of my driving and credit history records, and my payment of the appropriate membership
fees.
I have received and read a copy of the RFVV membership manual. I agree to observe and be bound by both the manual and fee schedule, including any amendments to either document. They form part of this contract. I recognize that RFVV may amend the membership manual and fee schedule.
If my application is accepted, RFVV will, subject to all the terms and conditions in the manual and this application, provide me with access to vehicles owned, leased or rented by it, and pay for RFVV Vehicle-related expenses such as gas, tires, insurance, maintenance and repairs.
I understand that RFVV will endeavor to ensure that the RFVV Vehicles are clean and well maintained, and will periodically inspect the RFVV Vehicles.
However, I recognize:
That during the use of the RFVV Vehicles, members are responsible for the maintenance and safety of the RFVV Vehicles;
That RFVV' periodic inspection of its vehicles is supplementary to the inspection of vehicles by members, and that RFVV relies on its members for primary inspection of vehicles that they use;
That as a member I will be responsible for ensuring the safe condition of any RFVV Vehicle that I drive; and
That RFVV does not make any representations or warranties as to the fitness or condition of any RFVV Vehicle.
I recognize that the manual states that I will be responsible for paying various fees, expenses, liens, fines and adhere to the prescribed time lines for their payment. I agree that this money will be a debt due and payable by me to RFVV.
I understand that RFVV will ensure that the RFVV vehicles are insured under a comprehensive insurance policy, the details of which are available from RFVV.
I recognize that RFVV will only be liable to me for any damages arising out of my use of a RFVV vehicle if RFVV's gross negligence has caused the damages. I waive any right I have to sue or make claims against RFVV and its directors, officers, agents, employees or members for damages arising from the fitness or condition of a RFVV vehicle, except in
cases of gross negligence.
I also agree to indemnify the RFVV directors, officers, agents or employees where it has incurred liability and expense as result of a claim by a third party for damages arising out of my use of a RFVV vehicle unless RFVV' gross negligence caused the damage.
I also waive any right I have to sue or make claims against RFVV and its directors, officers, agents, employees or members for a vehicle not being available at the time it was booked.
I recognize that I am not a representative, agent or employee of RFVV. I also agree to indemnify the RFVV for liability incurred to third parties as a result of my actions as a representative, agent or employee, whether I was acting within or outside the scope of my authority or apparent authority.
I hereby agree to protect, defend, indemnify and hold harmless the City, its officers, agents and employees and RFVV, its directors, officers, agents and employees from and against any and all claims, causes of action, suits, proceedings, losses, liabilities, damages, awards, costs, fees and expenses, of any nature, including, without limitation, reasonable attorneys' fees and all court costs (collectively, "Claims"), related to, arising out of or attributable to, in any way, to my action's or my agents' actions or any of their respective guests', invitees' or licensees' use of or presence within a RFVV vehicle and whether any such Claim is for injury or death to any person or property or otherwise.
By signing this agreement you agree to the terms and conditions. You also acknowledge that you have received the RFVV membership manual. RFVV will keep this last page for their records

I recognize that RFVV will only be liable to me for any damages arising out of my use of a RFVV vehicle if RFVV's gross negligence has caused the damages. I waive any right I have to sue or make claims against RFVV and its directors, officers, agents, employees or members for damages arising from the fitness or condition of a RFVV vehicle, except in
cases of gross negligence.
I also agree to indemnify the RFVV directors, officers, agents or employees where it has incurred liability and expense as result of a claim by a third party for damages arising out of my use of a RFVV vehicle unless RFVV' gross negligence caused the damage.
I also waive any right I have to sue or make claims against RFVV and its directors, officers, agents, employees or members for a vehicle not being available at the time it was booked.
I recognize that I am not a representative, agent or employee of RFVV. I also agree to indemnify the RFVV for liability incurred to third parties as a result of my actions as a representative, agent or employee, whether I was acting within or outside the scope of my authority or apparent authority.
I hereby agree to protect, defend, indemnify and hold harmless the City, its officers, agents and employees and RFVV, its directors, officers, agents and employees from and against any and all claims, causes of action, suits, proceedings, losses, liabilities, damages, awards, costs, fees and expenses, of any nature, including, without limitation, reasonable attorneys' fees and all court costs (collectively, "Claims"), related to, arising out of or attributable to, in any way, to my action's or my agents' actions or any of their respective guests', invitees' or licensees' use of or presence within a RFVV vehicle and whether any such Claim is for injury or death to any person or property or otherwise.
